Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Caldero mobile application and related services (the "Service"), operated by Devinspect Systems - FZCO ("Devinspect", "we", "us", or "our"). By using Caldero, you agree to these Terms.

1. Eligibility and Account Use

  • You must be at least 13 years old, or the minimum age required in your jurisdiction, to use Caldero.
  • You are responsible for maintaining accurate account information and safeguarding your login credentials.
  • You agree not to impersonate others or access accounts without permission.

2. Service Description

Caldero helps users log meals using photos and provides AI-based nutrition estimates, calorie tracking, progress insights, and reminders. Features may change over time.

3. AI and Health Disclaimer

  • Caldero’s nutrition analysis is generated by AI and is provided as an estimate.
  • AI results can be incomplete or inaccurate depending on image quality and food complexity.
  • Caldero is not a medical device and does not provide medical advice, diagnosis, or treatment.
  • You should consult a licensed healthcare professional for medical or dietary decisions.

4. Subscriptions, Billing, and Trials

  • Certain features require a paid subscription (weekly, monthly, or yearly plans where offered).
  • Purchases are billed through Apple App Store or Google Play, and are subject to those platform billing terms.
  • Subscription management, cancellation, and refunds are generally handled by the platform from which you purchased.
  • We may change pricing or plan features for future billing periods where permitted by law and platform rules.

5. User Content

  • You retain ownership of content you submit (for example, meal photos and entries).
  • You grant us a limited license to process, host, and display your content only as needed to operate and improve the Service.
  • You must have the right to upload content and must not submit unlawful, harmful, or infringing material.

6. Acceptable Use

You agree not to:

  • Reverse engineer, disrupt, or abuse the Service.
  • Use automated scraping/bot behavior without permission.
  • Upload malware, exploit vulnerabilities, or attempt fraud.
  • Use the Service in violation of applicable laws.

7. Intellectual Property

Caldero, including software, branding, design, and related materials, is owned by Devinspect or its licensors and protected by applicable intellectual property laws.

8. Third-Party Services

Caldero may rely on third-party services (for authentication, hosting, notifications, analytics, and AI processing). Your use may also be subject to those third-party terms and policies.

9. Suspension and Termination

We may suspend or terminate access if we reasonably believe these Terms are violated, if required by law, or to protect users and the Service.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, Devinspect will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill arising from use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Devinspect from claims, damages, and expenses arising from your misuse of the Service, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws applicable to Devinspect Systems - FZCO, without prejudice to mandatory consumer protections in your local jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after updates become effective means you accept the revised Terms.
